1. Introduction
SKY AGRO LTD
This Equipment Warranty Policy sets out the warranty terms applicable to brewing equipment purchased from SKY AGRO LTD. It applies to all equipment supplied by us, whether manufactured by SKY AGRO LTD or sourced from third-party manufacturers and supplied by us as distributor.
This policy forms part of our Terms and Conditions and should be read alongside them. As all sales are business-to-business, the statutory consumer rights provisions under the Consumer Rights Act 2015 do not apply. Your rights are as set out in this policy and in our Terms and Conditions.
2. Warranty Coverage
2.1 Warranty Period
All brewing equipment supplied by SKY AGRO LTD carries a 12-month warranty from the date of delivery to your premises, subject to the exclusions set out in clause 3 below. The specific warranty applicable to a product will be confirmed on the product page and in the order documentation.
2.2 What Is Covered
Subject to the exclusions in clause 3, SKY AGRO LTD warrants that equipment supplied will, at the time of delivery, conform to its description and be free from material defects in materials and workmanship.
Where a covered defect arises within the warranty period, we will, at our election:
- repair the defective equipment or component free of charge;
- replace the defective equipment or component; or
- issue a credit note or refund for the purchase price of the defective equipment, where repair or replacement is not practicable.
The remedy provided will be at our reasonable discretion, having regard to the nature of the defect and the age of the equipment. Where equipment is manufactured by a third-party supplier and supplied by us as distributor, the warranty is provided by us as seller. We will liaise with the manufacturer on your behalf to resolve warranty claims; however, your contractual relationship is with SKY AGRO LTD.
3. Warranty Exclusions
3.1 What Is Not Covered
The warranty does not cover:
- fair wear and tear during normal commercial use;
- consumable and wear parts, including but not limited to seals, O-rings, gaskets, filter pads, spray balls, hose fittings and similar items that are expected to require periodic replacement;
- damage caused by improper installation, commissioning or set-up where installation was not carried out by us or by a qualified installer;
- damage caused by use of the equipment in a manner inconsistent with its specification, including use beyond rated capacity, pressure ratings or temperature ranges;
- damage caused by failure to carry out routine maintenance in accordance with the manufacturer’s instructions;
- damage caused by the use of incompatible cleaning chemicals, particularly caustic or acid-based products used at concentrations or temperatures outside the equipment’s rated tolerances;
- damage caused by scale, limescale or mineral deposits arising from the quality of your water supply, unless you can demonstrate that the water quality was within the ranges specified for the equipment;
- damage caused by physical impact, accidental damage, misuse or negligence;
- electrical components damaged by incorrect voltage supply, power surges or failure to comply with applicable electrical installation standards;
- cosmetic defects that do not affect function, including surface marks, minor scratches or finish imperfections within industry tolerances;
- equipment that has been modified, altered or repaired by a party other than SKY AGRO LTD or an authorised service agent without our prior written consent; and
- equipment purchased second-hand or from an unauthorised reseller.
3.2 Duty to Inspect on Delivery
You must inspect equipment on delivery and report any visible damage or defects in accordance with our Delivery Policy. Where visible damage is not noted on the delivery note at the time of delivery, we may not be able to accept a warranty claim for that damage.
Latent defects (not reasonably discoverable on inspection at the time of delivery) must be reported to us as soon as they are discovered and in any event within the 12-month warranty period.
4. How to Make a Warranty Claim
4.1 Notification
To make a warranty claim, you must contact us in writing at info@sky-agro.com as soon as you become aware of the defect and within the 12-month warranty period. Please provide:
- your order number and the date of delivery;
- the product name, model number and serial number, where applicable;
- a clear description of the defect or failure;
- photographs or video showing the defect, where practicable; and
- details of how and where the equipment has been used, maintained and stored.
4.2 Assessment
On receipt of your claim, we will assess the information provided and may request additional information or arrange for inspection of the equipment. We aim to acknowledge warranty claims within 3 working days and to provide a proposed resolution within 10 working days of receiving all required information.
We reserve the right to require that the equipment (or the defective component) be returned to us for inspection before we determine whether the defect is covered by the warranty. Where we require return of the equipment, we will arrange and cover the reasonable cost of collection for valid warranty claims. For equipment located in remote or difficult-to-access locations, including Northern Ireland, Isle of Man, Jersey, Guernsey, Scottish Highlands (postcodes IV, KW, PH, PA, AB, HS), and other offshore or island locations, collection costs will be covered up to a reasonable amount to be agreed with you in advance; any excess collection costs beyond that agreed amount will be your responsibility. Where a claim is found not to be covered by the warranty, return shipping costs will be your responsibility.
4.3 Resolution
Where a warranty claim is accepted, we will carry out repair, replacement or issue a credit or refund as set out in clause 2.2. Our aim is to resolve accepted claims within a reasonable time, having regard to the nature of the repair required and the availability of replacement parts or equipment. Where repair requires the equipment to be returned to our premises or to a manufacturer’s facility, we will keep you informed of progress and expected timescales.
5. Manufacturer Warranties
Some equipment we supply is covered by a manufacturer’s own warranty in addition to the warranty provided by SKY AGRO LTD. Where a manufacturer’s warranty applies, details will be provided in the product documentation supplied with the equipment.
Manufacturer warranties run concurrently with, but do not extend, the warranty provided by SKY AGRO LTD as seller. You may claim under either the SKY AGRO warranty or the manufacturer’s warranty for any given defect, but not both. Where a manufacturer’s warranty period exceeds 12 months, you may claim directly under that warranty with the manufacturer after the SKY AGRO 12-month period has expired.
6. Installation and Commissioning
We strongly recommend that all brewing vessels, process equipment and electrical or refrigeration plant be installed and commissioned by a qualified professional. Improper installation is a common cause of equipment failure and will void the warranty in respect of damage caused by that installation.
Where we supply installation services, or where installation is carried out by an installer recommended by us, we will take responsibility for damage caused by our installation. Please contact us if you require guidance on qualified installers.
7. Spare Parts and Servicing
We stock spare parts for many of the equipment lines we supply, including consumable wear parts, replacement seals, gaskets and pump components. Availability of spare parts will be confirmed at the time of enquiry.
We recommend that you establish a routine maintenance schedule for all equipment in accordance with the manufacturer’s guidelines. Failure to maintain equipment adequately may affect both its performance and your warranty cover. For spare parts and servicing enquiries, please contact us at info@sky-agro.com or on +44 1327 828001.
8. Limitation of Liability
8.1 Our liability under this warranty is limited to the remedies set out in clause 2.2. Save as required by law, we are not liable for:
- any indirect, consequential or economic loss arising from equipment defects, including loss of production, loss of batch, business interruption or loss of profit;
- the cost of any ingredients, raw materials or products damaged or lost as a result of equipment failure; or
- the cost of any third-party labour engaged by you to carry out repairs without our prior written consent.
8.2 Our total liability to you in connection with any warranty claim shall not exceed the original purchase price paid for the defective equipment.
8.3 Nothing in this policy limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
